In using the services of “WHM Reseller Hosting”, applicants agree unconditionally to the following terms of service. “WHM Reseller Hosting” reserves the right to change these terms freely without any prior notice. It is therefore the user’s responsibility to regularly familiarize themselves with any changes and continue to adhere to the latest terms and conditions at the point in time. Failure to do so may lead to problems with the service provided in which case “WHM Reseller Hosting” will not be held responsible.
Content
Data stored in the user account must not exceed the allotted server space. Server space and ftp account is for sole use of the applicant. To ensure “WHM Reseller Hosting” is able to protect our users data, applicants must agree to take every step to keep their password private and notify us in the first instance that any breach of security is suspected.
“WHM Reseller Hosting” prohibits the use of, advertisement of and links to certain content for web hosting services. All statutes, regulations and laws in accordance to UK law must be adhered to at all time.
Any material including, but not limited to the following is unacceptable:
• Content which encroaches Third Party Intellectual Property or Proprietary rights
• Content in direct violation of Publicity and Privacy rights.
• Defamatory, Libellous, Threatening, Harassment;
• Abusive, Erotic, Pornographic or Obscene;
• Content that contains Viruses, Trojan Horses, Worms, Time-bombs, Cancel Bots, Corrupted files or any other similar software and/or programs which could lead to the damage of another parties operation or property.
• Contain Pirated or Hacking/ Phreaking Software (Warez)
• Software that is copyrighted and not freely available for distribution without cost. This applies to ROMs, ROM Emulators and Mpeg Layer 3 files (MP3)
Web Pages
“WHM Reseller Hosting” allows the account holder to use web and ftp space commercially. Hosting of Adult websites is prohibited as stated above.
Account holder is to take full responsibility for the content featured on their web page(s). In accordance with this, the account holder agrees to:
• Gain legal permission for any works used in the content of the page(s)
• Guarantee all content is in compliance with UK law
• Take responsibility for content which may be seen to be defamatory, confidential, secret or other proprietary material which can be seen through the page(s)
Failure to adhere to these stipulations can and will result in the removal of the offending material without notice.
Usage of Server
Running server processes such as talkers or IRC Bots from a web site is forbidden. Any loss or damage caused as a result of misuse, unavailability or services removed, is not the responsibility of “WHM Reseller Hosting” and as such we will not be held liable.
We reserve the right to cancel an applicant’s account without prior notice. Closure of an account will result in the deletion of all files including but not limited to web pages and files.
Availability
“WHM Reseller Hosting” is dedicated to honouring our advertised 99.9% uptime. However, there are times when it is imperative to upgrade and modify our servers in order to provide the best possible service to our users, which could cause downtime. We will not be held responsible for any unforeseen circumstances causing downtime.
Backups
We take every measure to prevent the loss of data. The backup of data on our servers are performed weekly but we urge our customers to have their own independent backup as we will not be held responsible for the loss of any data.
Data Protection
User’s participation in un-solicited bulk emailing or spam is strictly forbidden
Here at “WHM Reseller Hosting”, we take your privacy very seriously. We promise to never pass your details including your name and email address to 3rd parties. In addition to this, all account details are held in accordance to Data Protection Act 1998/2003. More details of this can be found in our Privacy Statement.
Domain Registration
Although we do not act as a domain registrar, we are able to provide the service through eNom. Users are obliged to recognise that upon registration of a domain, in alignment with standard practice, we will automatically show the WHOIS information. This means that user’s details may be seen by the public.
The renewal system is automated. A reminder of due payment will be sent to your email as the renewal date of your domain draws close. Users are required to notify us immediately in regards to renewals or cancellations.
IMPORTANT: Lateness in this matter may result in a charge of 20.00 GBP for administration fees and/or complete loss of domain name.
Bandwidth
All accounts have limited bandwidth. Failure to operate within these limitations may lead to the account being disabled. “WHM Reseller Hosting” reserves the right to take action without notice. Should this occur, all shared and reseller accounts affected will show an account suspension page.
Cancellation and refunds
There are no refunds for domains. After processing, the domain is registered to the user for the previously agreed time.
Monthly Hosting may be refunded. Each case is assessed individually and we reserve the right to deny refunds if we see fit.
The account holder has 14 days after the completion of a Yearly Hosting / Reseller order to request a refund. This will not include a refund for the domain as stated above. If the sign up is found to be fraudulent in any way, all applications for refund are rendered null and void.
In the event of closure of our service we will cease to host/renew your domain and website. No refunds will be given in this instance.
VPS and Dedicated servers
The customer is aware that construction of VPS and Dedicated servers will begin on receipt of payment for the order. No refund will be given here or thereafter this point. Only in the event of hardware failure or problems with configuration will a refund be awarded. Customers are asked to take this into consideration before applying for a refund.
Fraud sign ups
Fraud sign-ups are expressly forbidden. Suspicious orders of this nature will be investigated. In the future, if the account holder wishes to request a refund, any costs of an investigation incurred by us will be deducted from the final refund sum.
If the applicant is found to have signed up fraudulently legal action may be taken.
Illegal content
“WHM Reseller Hosting” will contact a customer immediately if their pages are found to contain illegal material. The customer will then have 24 hours to comply with our requests. Failure to do so will result in suspension of the account. We reserve this right to do so at any time.
Billing
When an account is due for renewal, the account holder will receive an invoice. This will be sent 10 days prior to the date of renewal followed up with reminders. Customers agree to pay the amount owed before the given date on the invoice. 3 days after the agreed date, if payment has not been received, the account will be suspended. If payment is still not received after the 10th day, the account will be removed altogether resulting in the loss of any and all data.
Hosting
Prices and/or resources are subject to change in all hosting packages.
Indemnification
In using the services provided, the user agrees to indemnify, protect, save and hold “WHM Reseller Hosting” against:
- Any and all demands, liabilities, losses, costs and claims including fair solicitor fees put forward against “WHM Reseller Hosting”, its agents, sub-contractors, its customers, officers and staff that may arise or are caused by a service given or carried out by or agreed to be done or any product sold by customer, its agents, employees or assigns
- Any damage/injury to property or person(s)as a result of the sale or distribution of a product in relation to the “WHM Reseller Hosting” server
- Any material given by a customer that actually or allegedly encroaches on the proprietary rights of a Third Party
- Copyright Infringement and/or Intellectual Property rights
- The sale of any faulty goods from “WHM Reseller Hosting” server
The account holder is reminded to respect the rights of others. Abusive or disrespectful behaviour towards staff or users of “WHM Reseller Hosting” is not tolerated and may result in cancellation of services with no option of a refund.

“WHM Reseller Hosting” is not liable for any damages your business may incur, “WHM Reseller Hosting” makes no actual or indicated guarantees at all, for services provided. “WHM Reseller Hosting” disclaims any warranty, merchantability or fitness for a particular purpose. This includes loss of data caused by delays, non-deliveries, wrong delivery or viruses as well as any and all service interruptions caused by “WHM Reseller Hosting” and its employees.
